Croatia Taken to European Court of Justice

The European Commission has referred Croatia to the Court of Justice of the European Union for failing to communicate the measures transposing Directive (EU) 2018/852 amending Directive 94/62/EC on packaging and packaging waste.
The directive aims to protect the environment and ensure good functioning of the internal market, setting recycling targets for EU countries. Croatia failed to communicate the complete transposition of all relevant provisions of the Directive into its national legislation and provided clear information on measures by which it considered it had fulfilled the various obligations imposed on it by the Directive. The Commission will ask the Court of Justice of the European Union to impose financial sanctions on Croatia, as per Article 260(3). Croatia responded in July 2021, informing the Commission that the Directive would be transposed by the Waste Management Act and legislative measures (’Pravilnik’) for packaging and packaging waste.
The European Green Deal and Zero Pollution Action Plan aim for a zero pollution level in the EU. Implementing EU legislation is crucial for human health and environmental protection. Proper waste management is essential for recovering economically valuable materials. Packaging recycling targets are set, with 65% recycling by 2025 and 70% by 2030. Member States must transpose Directive 2018/852 into national law.
