The European Commission has decided to bring a lawsuit against Poland over its legislation imposing additional costs on cross-border gas trading.
The Polish storage law requires gas traders importing more than 100mcm/year to secure 30 days of imports in storage in case of a threat to supply security. If traders want to keep the mandatory reserves abroad, they must book cross-border capacity and keep it idle in case they have to bring it to the country. The EC said the legislation imposes additional burden on market participants storing gas outside Poland, risks distortion of competition, hampers the functioning of the internal market, and jeopardises gas supply security.
The EC said its decision was the latest step in procedures in 2018, based on its own investigation and several complaints from market operators. Poland has long been criticised for the introduction of a storage law in 2016, which the government claimed was intended to improve supply security.
